1. Introduction

Welcome to Byyte. These Terms and Conditions (“Terms”) govern your use of our services, including website development and social media marketing (SMM). By engaging with our services, you agree to comply with and be bound by these Terms.

2. Services Offered

Byyte provides digital creative services including but not limited to:

  • Website design and development

  • Social media marketing (SMM)

  • Branding and digital strategy

  • Content creation and optimization

All services will be delivered as per the agreed proposal, quotation, or contract.

3. Client Responsibilities

The client agrees to:

  • Provide accurate and complete project requirements

  • Deliver necessary content (text, images, credentials, etc.) on time

  • Respond promptly to communications and approvals

  • Ensure that all provided materials do not violate any laws or third-party rights

Delays caused by the client may impact project timelines.

4. Payment Terms

  • A minimum upfront payment (as agreed) is required before the project begins

  • Remaining balance must be cleared as per agreed milestones or before final delivery

  • Payments once made are non-refundable unless otherwise specified

  • Late payments may result in project delays or suspension of services

5. Revisions and Changes

  • A limited number of revisions will be included as per the project agreement

  • Additional revisions or major changes beyond the scope may incur extra charges

  • Any change in project scope after approval may affect cost and timeline

6. Project Timeline

  • Timelines will be defined before project commencement

  • Byyte is not responsible for delays caused by client-side issues

  • Urgent or expedited requests may incur additional charges

7. Intellectual Property

  • Upon full payment, the client will receive rights to the final deliverables after paying the transfer Fee – INR 2000 only applicable for websites.

  • Byyte retains the right to showcase completed work in its portfolio

  • Any third-party assets used (fonts, plugins, stock images) will be subject to their respective licenses

8. Confidentiality

Both parties agree to maintain confidentiality of sensitive information shared during the project. This includes business strategies, login credentials, and proprietary data.

9. Service Limitations

  • Byyte does not guarantee specific results (e.g., rankings, engagement metrics, or revenue growth)

  • Performance of SMM campaigns depends on multiple external factors beyond our control

  • We are not liable for third-party platform changes (e.g., algorithm updates, policy changes)

10. Termination

  • Either party may terminate the agreement with written notice

  • In case of termination, payment for completed work up to that point must be settled

  • No refunds will be issued for work already completed

11. Liability

Byyte shall not be liable for:

  • Any indirect, incidental, or consequential damages

  • Loss of data, profits, or business opportunities

  • Issues arising from third-party tools, hosting services, or platforms

12. Support and Maintenance

  • Post-delivery support (if included) will be provided as per agreement

  • Ongoing maintenance services require a separate contract or subscription

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India.

14. Changes to Terms

Byyte reserves the right to update or modify these Terms at any time without prior notice. Continued use of our services implies acceptance of the updated Terms.
